Terms for text messaging with QNS, Incorporated

Program scope The initial QNS SMS program is intended for conversational and informational business communications with existing customers and prospects who have engaged with QNS, not general promotional or bulk marketing. Existing engagement does not by itself authorize every type of text message; QNS will obtain or rely on the permission permitted or required for the applicable message type. Promotional SMS will not be sent unless QNS establishes a separate compliant use case and obtains any additional consent required by law and carrier rules.
1. Agreement to These SMS Terms
These SMS Terms & Conditions ("SMS Terms") govern text messages sent by or on behalf of QNS, Incorporated ("QNS") to a telephone number you provide or use to communicate with QNS. If you send QNS a text message, QNS may respond to your inquiry and continue the conversation as reasonably related to your request. Initiating a text conversation does not by itself constitute consent to recurring promotional or marketing messages. By opting in to other QNS text messages, you agree to these SMS Terms and the QNS Privacy Policy.
2. Types of Messages
Depending on your relationship with QNS and the consent you provide, QNS may send conversational or informational messages relating to:
Responses to questions and human-to-human customer conversations.
Appointment, meeting, and scheduling confirmations or changes.
Requests for information needed to evaluate, quote, contract, provision, install, activate, or support a product or service.
Order, project, provisioning, installation, deployment, readiness, shipping, and status updates.
Service coordination, customer care, troubleshooting, and administrative communications connected to an active QNS relationship.
Other non-promotional communications that you specifically request or authorize, including appropriate informational follow-up to an existing QNS customer relationship or a prospect interaction with QNS.
Unless QNS separately obtains consent appropriate for a promotional program, QNS will not use this operational SMS program to send general sales promotions, advertising campaigns, or third-party marketing messages.
3. Consent and Enrollment
You may authorize QNS text messaging by initiating a text conversation with QNS, giving QNS documented verbal authorization during a business conversation, providing written or electronic authorization, or using another method that clearly communicates permission and is permitted for the relevant type of text messages. QNS may record the date, method, source, scope, and person who documented that authorization in its business systems.
Providing a telephone number or submitting a QNS online form does not, by itself, authorize recurring QNS text messages. If you text QNS first, QNS may reply to and continue that conversational exchange as reasonably related to your request and applicable law. A user-initiated conversation does not by itself authorize unrelated recurring or promotional messaging.
For proactive informational messages, QNS will obtain and record the consent or other permission required for the applicable message type before initiating messages. An existing customer relationship, prior inquiry, or prior engagement may support conversational or informational contact only to the extent permitted by applicable law and carrier rules; it does not authorize promotional texts and does not override a prior opt-out.
Consent to receive SMS is not a condition of purchasing any QNS product or service.
You represent that you are authorized to use the mobile number you provide and to consent to communications at that number. If the number changes ownership or you no longer control it, please notify QNS.
4. Message Frequency and Charges
Message frequency varies based on your interaction with QNS, the status of an inquiry, project, order, or service, and the communications you request. Message and data rates may apply according to your mobile plan. QNS does not charge a separate fee for opting in to the SMS program, but your carrier may charge for messages or data.
5. How to Opt Out
You may revoke SMS consent at any time. Reply STOP to a QNS text message to opt out. QNS will also treat other clear, reasonable language expressing that you want QNS text messages to stop as an opt-out request. You may also communicate an opt-out request through the QNS contact page or by telephone.
QNS will process opt-out requests promptly. After an opt-out request, QNS or its messaging provider may send one non-promotional confirmation that the opt-out has been processed. QNS will not send further consent-based text messages to that number unless you subsequently opt in again.
If you clearly request that all QNS text messages stop, QNS will treat that as a company-wide SMS suppression request across QNS-controlled messaging systems rather than limiting the request to a single project or QNS sending number, unless you expressly tell QNS otherwise. QNS adopts this broader suppression approach as an internal operating standard when the request clearly applies to all QNS texts.
6. How to Get Help
Reply HELP for assistance. Where supported by the messaging platform, the HELP response will identify QNS, provide a customer-service contact method or program assistance, and explain how to opt out by replying STOP. You may also call QNS at 619-880-8709 or visit https://qnsnow.com/contact.
7. Re-Enrolling
If you previously opted out, you may opt back in by replying START where supported or by providing new documented consent to QNS. QNS may update its messaging systems to reflect your renewed consent before sending additional messages.
8. Privacy and SMS Consent
QNS handles personal information in accordance with the QNS Privacy Policy at https://qnsnow.com/policies/privacy. Mobile opt-in data and text-message consent are not sold or shared with third parties or affiliates for their own marketing or independent messaging. QNS may use messaging providers and other service providers solely to transmit, administer, secure, or support QNS messages.
SMS consent belongs to the QNS relationship in which it was obtained. A service provider, supplier, referral source, or strategic partner does not gain an independent right to text you merely because QNS may share other information with that organization for service delivery or a permitted partner update.
9. Message Delivery and Carrier Limitations
Wireless carriers and messaging networks are independent of QNS. Delivery can be delayed or fail because of carrier filtering, network availability, device settings, number changes, unsupported destinations, or other circumstances outside QNS’s control. Participating carriers are not responsible for delayed or undelivered messages. QNS does not guarantee that every message will be delivered or received within a particular time.
10. Sensitive Information
Do not send passwords, payment-card numbers, bank credentials, Social Security numbers, private authentication codes, one-time passcodes, private keys, firewall or administrator credentials, Wi-Fi passwords, access-control or alarm codes, or other highly sensitive information by SMS. QNS may direct you to another channel when a secure method is appropriate.
11. Changes or Termination of the Program
QNS may change, suspend, or discontinue an SMS program or sending number. QNS may update these SMS Terms to reflect changes in law, carrier requirements, technology, or QNS practices. The current version and effective date will be posted on qnsnow.com. Material changes will be handled as required by applicable law.
12. Relationship to Other QNS Terms
These SMS Terms address text messaging only. The QNS Privacy Policy governs information practices. The QNS Website Terms of Use at https://qnsnow.com/policies/website-terms govern use of the public website. If you purchase QNS products or services, the applicable signed agreement, order, statement of work, and QNS Terms & Conditions may also apply.
