Terms governing use of qnsnow.com and QNS public online content

Separate from customer contracts These Website Terms govern use of the public website. They do not by themselves create a customer service contract or replace an executed QNS Agreement, Order, SOW, or an independent provider agreement.
1. Acceptance of Website Terms
These Website Terms of Use ("Website Terms") provide rules for access to and use of qnsnow.com and QNS public online content and tools. If you do not agree with these rules, do not use the website. Where QNS intends an online action to create a material binding agreement, QNS may present a separate agreement or clear action-linked notice identifying the terms accepted by that action. These Website Terms do not by themselves create a customer service contract.
2. Informational Purpose; No Binding Service Order
Website content is provided for general business information and to help prospective and existing customers understand QNS services and approaches. Unless the website expressly states otherwise, website descriptions, examples, assumptions, comparisons, configurator outputs, availability statements, and budgetary pricing are not a binding offer, service order, warranty, or guarantee. A binding customer commitment arises only through the agreement or authorization process applicable to the transaction.
A submission through a configurator, inquiry form, scheduling tool, or partner-program page may create a QNS engagement record or request for review, but does not create a carrier order, supplier order, shipment, or binding contract unless QNS expressly states that result and the required authorization has been completed. Where a QNS-controlled form displays a communication notice at submission, submitting the form authorizes QNS to respond using the email address and telephone number provided for the request and resulting engagement, consistent with that notice and the QNS Privacy Policy. Providing a telephone number or submitting a form does not, by itself, authorize recurring SMS; QNS text messaging is governed separately by the QNS SMS Terms and applicable consent requirements.
3. Website Accuracy and Changes
QNS seeks to keep website information useful and accurate, but products, providers, pricing, technical requirements, service areas, availability, and market information change. QNS may update, correct, remove, or replace website content without notice. You should confirm material requirements, pricing, serviceability, compatibility, and contract terms before relying on website content for a purchase or deployment decision.
4. Comparisons and Third-Party Information
QNS may publish comparisons, educational material, or references to third-party products, providers, technologies, or service models. Such content may be based on publicly available information, QNS experience, or stated assumptions and is not a warranty about another company. Third-party names, marks, and content belong to their respective owners. QNS may have commercial relationships with some companies discussed on the website.
5. Permitted Use
You may use the website for lawful business evaluation, communication with QNS, and ordinary access to QNS content and tools. You may download or print reasonable portions of publicly available content for internal business use, provided you do not remove notices, misrepresent authorship, or commercially redistribute QNS proprietary material.
6. Prohibited Website Activity
Attempting to gain unauthorized access to the website, accounts, systems, data, or administrative functions.
Interfering with website availability, security controls, rate limits, authentication, or normal operation.
Introducing malware, malicious code, automated attacks, credential-stuffing, scraping that materially burdens the service, or other harmful activity.
Using website content or forms for fraud, impersonation, unlawful activity, spam, harassment, or infringement.
Reverse engineering protected website functionality except to the limited extent such restriction is prohibited by law.
Submitting information you do not have authority to provide or using another person’s contact information deceptively.
7. Accounts and Credentials
If QNS provides access to a protected account or console, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Do not share another person’s administrative credentials. Notify QNS promptly if you reasonably suspect unauthorized access.
8. User Submissions and Feedback
You retain ownership of information and materials you submit to QNS and represent that you have authority to provide them for the relevant business purpose. You grant QNS the right to use, copy, process, and disclose submitted information as reasonably necessary to respond to your request, operate the website and QNS systems, prepare or administer an engagement, and otherwise act in accordance with the QNS Privacy Policy and applicable agreements. Do not submit passwords, payment-card information, Social Security numbers, one-time authentication codes, private keys, administrator credentials, access-control codes, or other highly sensitive information through a public website form unless QNS specifically requests it through a designated method.
If you voluntarily provide non-confidential suggestions or feedback about QNS services or website functionality, QNS may use that feedback without restriction or compensation, provided QNS does not use your Confidential Information in violation of an applicable agreement.
9. Privacy

10. Third-Party Sites and Tools
The website may link to or embed services operated by third parties, such as scheduling, mapping, communications, or provider resources. QNS does not control third-party websites and is not responsible for their content, availability, security, or privacy practices. Your use of a third-party service may be subject to that provider’s own terms and policies.
11. Intellectual Property
The website, QNS name and logos, text, graphics, design elements, workflows, original illustrations, documentation, and other QNS content are owned by QNS or used under license and are protected by applicable intellectual-property laws. Except for the limited internal-use permission above, no license is granted to reproduce, publish, sell, modify, create derivative commercial content from, or use QNS marks without permission.
12. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND PUBLIC CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. QNS DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF EVERY SECURITY VULNERABILITY.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM USE OF OR INABILITY TO USE THE PUBLIC WEBSITE. This section does not alter liability terms in an executed customer agreement and does not apply to fraud, willful misconduct, or liability to the extent applicable law does not permit it to be excluded or limited.
14. Changes; Suspension
QNS may modify the website or these Website Terms. The current version number and publish/effective date will be posted with the Terms. QNS may restrict or suspend access to protect security, systems, users, QNS rights, or legal compliance. The 30-day contract-update process in the QNS Terms & Conditions applies to active direct QNS contracts that incorporate those commercial Terms; it does not create a 30-day delay for ordinary changes to these Website Terms governing public website use.
15. Governing Law
Unless applicable law requires otherwise, these Website Terms are governed by California law, and disputes arising solely from use of the public website will be brought in state or federal courts located in San Diego County, California.
